BracketForge is a free-to-play bracket prediction platform for entertainment purposes only. No real money is wagered, won, or lost on this platform. BracketForge does not collect, hold, or transmit user funds at any time. Entry fees tracked within pools are collected and distributed directly between pool participants outside of this platform — BracketForge facilitates tracking only and is never a party to any payment.

1. Acceptance of Terms

By accessing or using BracketForge ("the Service", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. We reserve the right to update these Terms at any time; continued use of the Service constitutes acceptance of the revised Terms.

2. Description of Service

BracketForge provides an online platform for creating, managing, and participating in bracket prediction pools for NCAA college basketball tournaments. Features include bracket picking, pool scoring, standings, AI-powered insights (Premium), and commissioner tools. The Service is provided "as is" without warranties of any kind.

3. User Accounts

  • You must be at least 18 years old to create an account and use the Service.
  • You are responsible for maintaining the security of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You must provide accurate information when creating your account.
  • You may not create multiple accounts to circumvent pool rules or gain an unfair advantage.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Use the Service in connection with real-money gambling, sports betting, or any other wagering activity.
  • Post content that is abusive, defamatory, obscene, or otherwise objectionable in pool messages or communications.
  • Attempt to gain unauthorized access to any part of the Service.
  • Interfere with or disrupt the integrity of the Service.
  • Use automated tools to interact with the Service without our prior written consent.
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity.

5. Pools and Commissioner Responsibilities

Pool commissioners (creators) are responsible for:

  • Accurately communicating pool rules, entry fees, and payout structures to participants.
  • Collecting and distributing any entry fees or prize money directly between participants. BracketForge does not handle funds.
  • Ensuring that their pool operates in a lawful manner in their jurisdiction.
  • Using the platform's payment tracking tools for record-keeping only — not as a financial instrument.

BracketForge bears no responsibility for disputes between pool participants regarding entry fees, payouts, or pool administration.

6. Premium Services

BracketForge offers optional paid features ("Premium") including User Premium (annual auto-renewing subscription) and Pool Premium (one-time per-season fee). By purchasing Premium, you agree to our payment terms processed through Stripe. Subscriptions auto-renew unless cancelled before the renewal date. Fees are non-refundable except as required by applicable law. We reserve the right to modify Premium pricing with reasonable advance notice.

7. Intellectual Property

NCAA team names, logos, and related marks displayed on BracketForge are the property of their respective owners. They are displayed on this platform for informational and editorial purposes under fair use in the context of a non-commercial bracket prediction service. We do not claim ownership of any NCAA marks, team identities, or related intellectual property.

The BracketForge name, logo, and platform code are proprietary. Nothing in these Terms grants you a license to use our marks or software outside of your use of the Service.

8. Trademark Notice

"March Madness" is a registered trademark of March Madness Athletic Association, a joint venture of the National Collegiate Athletic Association (NCAA) and the American Sports Licensing Association (ASLA). BracketForge is not affiliated with, endorsed by, or sponsored by the NCAA, March Madness Athletic Association, or any related entity.

9. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, BRACKETFORGE DISCLAIMS ALL WARRANTIES INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL BRACKETFORGE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Termination

We reserve the right to suspend or terminate your account at our discretion, with or without notice, if you violate these Terms or for any other reason we deem appropriate. Upon termination, your right to use the Service ceases immediately.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through binding arbitration, except where prohibited by law.
